Terms and conditions of sale tend to govern the relationship between:

GENERAL CONDITIONS FOR SELLING COOKING CLASSES TO INDIVIDUALS
I. General information
Any purchase made from Frogs kitchen on the Website is subject to these terms and conditions of sale. When making a purchase, the customer acknowledges that they have been read, understood and accepted without reservation.
Frogs kitchen reserves the possibility to adapt or modify, for legitimate reasons, at any time the present terms and conditions of sale by publishing a new version on its website. In this case, the applicable conditions will be those in use on the date of the purchaser’s order.
The client states that he has the legal capacity to validly contract the services offered by Frogs kitchen on the Website.
I. Information on the services offered
Frogs kitchen aims to market on its website training in cooking and pastries for individuals.
Information about the courses offered during the so-called courses, i.e. the content of the course, as well as its price, are available on the website. The dates, and the times, will be chosen by the individual when booking. Classes will take place at the home of the individual. These services are offered within the limits of available places or stocks.
Frogs kitchen’s other services, such as courses for groups of individuals of more than 8 people, and businesses, are not available for sale online.
I. Registration and booking arrangements
Registration for cooking classes is on the website, for up to 8 people. The date and schedule are chosen by the buyer, depending on the available slots. The course will take place at the buyer’s home. It is appropriate for the buyer to determine if there is enough room in his home for the whole group booking this course.
Confirmation of registration is sent by Frogs kitchen, after payment has been validated, by email to the email address indicated by the buyer. Confirmation of registration generates acceptance of the general terms of sale by the customer.
Frogs kitchen reserves the right to cancel the booking when the customer’s identity and/or email address are incorrect.
Frogs kitchen reserves the right to refuse access to the participant if the participant does not have his partner gift voucher.
I. Price and condition of settlement
The price of the courses in use is the one on the website when booking.
Prices are displayed in euros, excluding taxes. Frogs kitchen being a self-enterprise, no VAT will be charged for this course.
The payment of the total amount of the purchased service is made by credit card at the time of the validation of the booking (to be adapted according to the agreement with the bank), or by PayPal.
The settlement can also be made by means of gift voucher as shown in point 5 below of the terms and conditions of sale.
I. Gift vouchers
The vouchers accepted are those purchased directly from the website.
Gift vouchers are not nominative. They are valid only for the type of course indicated on the voucher or for a course whose amount is less or equal to the value of the voucher.
Frogs kitchen gift vouchers are valid for one year from the date of issue and will no longer be accepted after that date has passed.
Gift vouchers are non-refundable.
I. Right of retraction
Frogs kitchen cooking classes are a provision of catering services provided on a date or in a periodicity determined by the provisions of Section L.221-28 of the Consumer Code. As a result, the customer is informed that he does not benefit from the right of withdrawal provided by the provisions of Article L.221-18 of the Consumer Code.
Therefore, a reservation cannot be cancelled and refunded.
A reservation may be postponed if this request is communicated in writing on the address: contact@frogskitchen, at least 72 hours before the start of the course. The postponement can only be done once.
When booking with a gift voucher, the second date of registration must not exceed the end date of the gift voucher.
When booking a “self-employment” formula, the payment must be made in full. The booking date corresponds to the first course of the formula. The other courses will be set together between Frogs kitchen and the buyer, during the first course.
I. Modified by Frogs kitchen
Frogs kitchen reserves the right to cancel a cooking class in case of force majeure.
Frogs kitchen also reserves the right to cancel or change the composition and/or dates and times of courses and/or location, in case of:
Number of participants less than 8 people compared to the number originally planned
Lack of supply of the products necessary to carry out the proposed recipe, for reasons beyond the control of Frogs kitchen (market hazards: seasonal products, or exceptional character)
The intervener’s failure
In the event of a cancellation by Frogs kitchen, the latter will notify the customer as soon as possible, schedule the course at a later date and reserve a place for the client if he wishes, or give him a property for a course similar or of the same value as the one that has been cancelled.
No refunds will be made by the Frogs kitchen.
I. Responsibility
For the course to run smoothly, the client must be attentive and respect the hygiene and safety rules given to him by Frogs kitchen.
Frogs kitchen cannot be held responsible for the damage suffered by the customer during the technical exercises performed during the cooking class.
Frogs kitchen cannot be held responsible for any damage or loss of items and personal belongings brought by participants.
Any reaction in relation to food ingested during or outside the course is not the responsibility of Frogs kitchen. It is up to the customer to check that the meals cooked during the workshops do not contain foods for which he is allergic.
The client who wishes, at the end of the course, to redo a recipe proposed by the Frogs kitchen, does so under his sole responsibility. Thus, it is up to him to ensure that no risk results from the preparation of the recipe or the consumption of the products he has acquired himself.
The recipes, sent to the client by e-mail after the course, do not necessarily return all the information and data provided to the client during the course. Frogs kitchen strives to ensure that these documents provide the main information that allows the client, along with the teachings received from Frogs kitchen during the course, to realize the recipe offered during the course.
I. Applicable law
These terms and conditions of sale are governed by French law and in particular by the regulation of distance selling.
Any complaint must be made to Frogs by mail at 10 Rue du Petit Poucet, 45000 Orléans, or e-mail to the following email address: contact@frogs-kitchen.com.
Any dispute relating to the interpretation or implication of these terms and conditions of sale will, if it could not be resolved amicably, be brought to court. The competent court is the court where the defendant is domiciled or where the benefit is performed.
The data collected on the Website can be used as evidence of the exchanges and transactions between Frogs kitchen and the customer, and of the bookings made by the customer.
I. Data protection guarantee
As part of their contractual relationship, the parties agree to comply with the current regulations applicable to the processing of personal data and, in particular, the European Parliament and Council Regulation (EU) 2016/679 applicable from 25 May 2018 (the ‘European Data Protection Regulation’).
On the occasion of the implementation of the General Data Protection Regulations that came into force on 25 May 2018, Frogs kitchen informs you that it has never disseminated or will never disseminate your personal data to third parties. We use the data you have entrusted to us only to keep you informed of our company’s activities.
I. Intellectual property
The recipes offered by Frogs kitchen, developed during the course by the client and subsequently sent to the customer by e-mail, are the property of Frogs Kitchen.
The exploitation or use of these revenues for the purpose of publishing, reproducing or representing them is permitted for exclusively private or non-commercial use, subject to compliance with three conditions:
Free broadcasting,
Reproduction without tampering with documents,
Respect for fatherhood with the clear and readable quote from the source, Frogs kitchen.
TERMS AND CONDITIONS OF SALE FOR PRIVATE EVENTS
I. General information
Apart from cooking classes available for sale online, Frogs kitchen offers the opportunity to organize events tailored to your needs. These events may include cooking classes or competitions, for groups of individuals or for businesses.
Event information such as content, dates, times and location and price are mentioned on the quote after discussion with the customer.
The quote is communicated by Frogs kitchen to the customer by email.
The acceptance of the quote by email by the customer implies on the part of the customer the full acceptance of the general terms of sale in use on the day of the communication of the quote, available on the website.
The client states that he has the legal capacity to validly contract the services offered in the quote by Frogs Kitchen.
I. Booking the event
At the time the customer accepts the quote, a down payment of 50 of the HORS TAXES (HT) amount of the event price is due. The customer is required to make the payment of the down payment due to Frogs kitchen no later than 15 days before the event.
As long as the down payment is not settled the booking of the event is not final. The receipt of the deposit gives rise to a written confirmation by Frogs kitchen.
Any late payment may result in the postponement of the event for which Frogs kitchen cannot be held responsible. Thus, in the event of a postponement of the event due to the delay in payment of the deposit, the deposit remains due and the customer will be able to rearrange the event, on the same price conditions, within three months of the initial event, subject to the availability of Frogs kitchen and payment of the down payment. If the event is not reorganized within this time, the customer loses his right to the event and remains required to pay the down payment to Frogs kitchen as damages.
I. Price and condition of settlement
Event prices are expressed in euros Excluding Taxes (HT) on the quote. The payment of the instalments and the balance of the price is by bank transfer or cheque denominated at the order of Aurélie Gonzalo, sent to the address of the head office of Frogs kitchen
Under the law of August 4, 2008, any unpaid amount 30 days after the Event results in, without prior notice, payment of late penalties at the rate of three times the statutory rate in force.
I. Right of retraction
Events conducted by Frogs kitchen are a provision of catering services provided on a date or in a periodicity determined by the provisions of Section L.121-20-4 of the Consumer Code.
As a result, the customer is informed that he does not benefit from the right of withdrawal provided by the provisions of Article L.121-19 of the Consumer Code.
I. Changing the event after accepting the quote
Change of 15 or less than the amount of the quote at the customer’s request
If the change results in a change in the total amount of the HT quote of less than or equal to 15 and is forwarded to Frogs kitchen no later than 7 days before the day of the event, then this will result in a reduction or increase in the total price of the event in accordance with the quote.
If the change results in a decrease in the total amount of the HT quote of less than or equal to 15 and is forwarded to Frogs kitchen less than 7 days before the day of the event, then it cannot result in a reduction in the price.
If the amendment results in an increase in the total amount of the HT quote of less than 15 and is forwarded to Frogs kitchen less than 7 days before the day of the occurrence, then it will be subject to the formally expressed agreement of Frogs kitchen based on the possibility of additional supplies. The cost of additional participants or services will be billed additionally.
Change of more than 15 of the quote amount at the customer’s request
If the change results in a decrease in the total amount of the HT quote greater than 15, then it will not result in a reduction in the price or an upward revision of the price per person.
If the amendment results in an increase in the total amount of the HT quote greater than 15, then it will be subject to the formally expressed agreement of Frogs kitchen based on the possibilities of additional supplies. The cost of additional participants or services will be billed additionally.
I. Total cancellation of the event after the customer accepts the quote
If the request for full cancellation of the event is forwarded after the customer accepts the quote to Frogs kitchen in writing no later than a fortnight before the event, the total amount of the down payment will be retained but may be used for a new event within six months of the initial event, subject to Frogs kitchen availability. Since the event was not reorganized within six months, the client loses his right to the event and the down payment will remain acquired by Frogs kitchen as damages for late cancellation.
If the request for a complete cancellation of the event is forwarded after the customer accepts the quote in writing after the above deadline, the down payment will remain acquired by Frogs Kitchen as damages for late cancellation.
I. Responsibility
For the cooking class to run smoothly, the customer and participants in the event must be attentive and respect the hygiene and safety rules given to them by Frogs kitchen.
Frogs kitchen cannot be held responsible for the harm suffered by participants during technical exercises during a cooking class at an event.
Frogs kitchen cannot be held responsible for any damage or loss of items and personal belongings brought by participants.
Any reaction in relation to food ingested during or outside the course is not the responsibility of Frogs kitchen It is the customer’s responsibility to verify that meals cooked during the workshops do not contain foods for which he is allergic.
Participants have the opportunity to take the dishes prepared during the course, to consume them outside the venue of the event, under their own responsibility. Dishes should be kept cool and eaten during the day.
The client expressly acknowledges that the participant who wishes, following the course given as part of an event, to redo a recipe proposed by Frogs kitchen, does so under his sole responsibility. Thus, it is up to him to ensure that no risk results from the preparation of the recipe or the consumption of the products he has acquired himself.
Recipes that can be accessed online, on the website, by the customer do not necessarily return all the information and data provided to the customer during the course offered during an event. Frogs Kitchen is committed to ensuring that these documents provide the key information that allows the client, along with the lessons received from Frogs kitchen during the course taught as part of an event, to realize the recipe offered during the course.
